Luxury athletic brand Lululemon has initiated legal action against wholesale giant Costco, alleging that the retailer is selling unauthorized copies of its signature athleisure designs under Costco’s Kirkland Signature brand.
The lawsuit, which was filed last Friday, asserts that Costco’s “Infringing Products” create an “improper association” with Lululemon’s authentic merchandise. The complaint highlights the prevalence of terms like “knockoffs” and “dupes” in the fashion world, pointing to social media trends such as the hashtag #LululemonDupes as evidence of consumers seeking cheaper alternatives that mimic Lululemon’s designs.
Lululemon contends that Costco is unlawfully leveraging its established reputation, goodwill, and significant investment in product development by offering these allegedly copied designs. In a statement, Lululemon emphasized its commitment to protecting its intellectual property rights, stating, “As an innovation-led company that invests significantly in the research, development, and design of our products, we take the responsibility of protecting and enforcing our intellectual property rights very seriously and pursue the appropriate legal action when necessary.”
Costco has not yet publicly responded to the allegations.
