The Trump administration is moving to immediately fine individuals in the United States illegally, eliminating the previous 30-day warning period. A new rule, set to be published today, June 27, 2025, in the Federal Register, allows the government to issue penalties of up to $1,000 per day without prior notice.

This policy shift, spearheaded by the Departments of Justice and Homeland Security, targets those who enter the U.S. unlawfully, disregard final removal orders, or fail to comply with voluntary departure orders from a judge. Fines will range from $100 to $500 per illegal entry, up to nearly $10,000 for failing to voluntarily deport after a judge’s order, and up to $1,000 daily for non-compliance with removal orders.

U.S. Homeland Security Secretary Kristi Noem, who was in Guatemala City on June 26, 2025, for a security program agreement, oversees this intensified enforcement. Assistant DHS Secretary Tricia McLaughlin stated on Thursday, “The law doesn’t enforce itself; there must be consequences for breaking it.” She added that President Trump and Secretary Noem are committed to enforcing immigration laws more effectively.

While fines for undocumented migrants were initiated during President Trump’s first term, paused during the Biden administration, and restarted in January, this new rule signifies a significant acceleration of the process. Individuals who utilize the Customs and Border Protection’s CBP Home app for self-deportation will have any levied fines waived. As of June 13, DHS had already issued 10,000 fine notifications under the existing system.
