Minnesota State Senator Nicole Mitchell has officially resigned from her position following her conviction on felony burglary charges. The Democratic lawmaker, who represents a suburban district east of St. Paul, had faced growing calls for her immediate departure since a jury found her guilty of first-degree burglary and possession of burglary tools.

Mitchell’s lawyer confirmed her resignation, which aligns with her previously stated plan to step down by early August to finalize legislative duties and secure health insurance for her son. Her departure creates a temporary 34-34 tie in the closely divided state Senate, where Mitchell often cast crucial votes.

Governor Tim Walz has indicated he will call a special election to fill the vacant seat as soon as feasible. The goal is to allow candidates sufficient time to campaign and ensure the seat is filled before the Legislature reconvenes for its regular session in February.

Mitchell was arrested in April 2024 after breaking into her estranged stepmother’s home. She initially claimed she sought items like her late father’s ashes, but later testified she intended only to check on her stepmother’s well-being.
