A federal judge has issued a temporary injunction, blocking the Trump administration’s efforts to significantly expand the speedy deportation of undocumented migrants detained within the United States. This ruling represents a considerable setback for President Donald Trump’s stated goal of rapidly removing a million individuals annually during his second term.

U.S. District Judge Jia Cobb, a Biden nominee, questioned the administration’s expanded use of the federal expedited removal statute, suggesting it may infringe upon individuals’ due process rights. In her 48-page opinion issued Friday night, Cobb emphasized that even those who entered the country illegally are entitled to Fifth Amendment protections, stating that prioritizing speed over due process could lead to erroneous removals.

The Department of Homeland Security (DHS) had moved to broaden expedited removal, which previously applied only to migrants apprehended near the border and within 14 days of entry, to include those in the interior of the U.S. for up to two years. DHS responded to the ruling, asserting that Judge Cobb’s decision disregards the President’s constitutional authority and federal law, reiterating the administration’s mandate to deport certain individuals.

This latest ruling follows an earlier decision this month by Judge Cobb, who also temporarily blocked the administration’s attempts to expand fast-track deportations for immigrants who entered legally under humanitarian parole, a move that could affect hundreds of thousands. Lawsuits from organizations like the American Civil Liberties Union and other immigrant rights groups have challenged these expanded policies.
