A federal judge has once again temporarily halted former President Donald Trump’s executive order aimed at ending birthright citizenship for certain US residents. The decision comes weeks after the Supreme Court issued new guidelines on the issuance of universal injunctions by federal courts.

The class-action lawsuit, filed by the American Civil Liberties Union (ACLU) on behalf of immigrant parents and their infants, successfully argued that Trump’s order violates the 14th Amendment, which grants citizenship to all persons born or naturalized in the United States and subject to its jurisdiction. A New Hampshire judge approved the class action and issued a temporary injunction, preventing the order from taking effect as the legal challenge proceeds.

The White House, under the Trump administration, had vigorously challenged the validity of such rulings, with spokesman Harrison Fields describing the decision as an “obvious and unlawful attempt to circumvent the Supreme Court’s clear order against universal relief.” The administration had vowed to fight what it called “attempts of these rogue district court judges to impede the policies President Trump was elected to implement.”

This ruling marks another pause for an order that was a key priority for Trump, who sought to revoke birthright citizenship for babies born to undocumented immigrants and foreign visitors as part of his broader immigration crackdown. The judge has granted the government seven days to appeal the decision. The Supreme Court had previously sided with the Trump administration in a 6-3 ruling that broadly curtailed judicial power to issue nationwide injunctions, though that ruling did not address the constitutionality of the birthright citizenship order itself. Following that Supreme Court decision, Trump’s order had been set to take effect on July 27.
