This decision was made in exchange for Hernandez Reyes’s cooperation in the case.

Hernandez Reyes, 38, had previously been convicted of migrant smuggling and illegally reentering the United States after deportation. He also pleaded guilty to “deadly conduct” following an incident where he fired a gun while intoxicated in a Texas community. Records reviewed indicate that Hernandez Reyes was released early from federal prison to a halfway house and granted permission to remain in the U.S. for at least a year.

Prosecutors identified Hernandez Reyes as the “first cooperator” in the case against Abrego Garcia. The Department of Homeland Security maintains that Hernandez owned the SUV Abrego Garcia was allegedly using to smuggle migrants when he was stopped by the Tennessee Highway Patrol in 2022, an incident central to the criminal investigation.

Abrego Garcia, a construction worker residing in Maryland, became a symbol of controversy surrounding Trump’s strict immigration policies after his mistaken deportation to El Salvador in March. Following mounting pressure and a Supreme Court order, he was returned to the U.S. to face smuggling charges, which his attorneys have called “preposterous.”

Amid preparations by a federal judge in Nashville to release Abrego Garcia to await trial, concerns arose that U.S. Immigration and Customs Enforcement (ICE) might detain and deport him again. Consequently, Abrego Garcia’s attorneys requested a federal judge in Tennessee to delay his release, citing “contradictory statements” from the administration regarding his potential deportation. They expressed a lack of faith in representations made by the Justice Department on this issue. Abrego Garcia has pleaded not guilty to the charges.
