Luigi Mangione, accused in the high-profile killing of UnitedHealthcare executive Brian Thompson, achieved a significant legal victory on Tuesday as a judge dismissed the two most severe state charges against him: first-degree murder and second-degree murder, both initially framed by prosecutors as terrorism crimes.

Judge Gregory Carro, overseeing Mangione’s state criminal case, ruled that the evidence presented for the terrorism-related charges was “legally insufficient.” This decision was delivered during a brief proceeding in a Manhattan court.

Despite this dismissal, Mangione continues to face an additional second-degree murder charge at the state level, alongside significant federal murder charges relating to Thompson’s death last December. Prosecutors for the Manhattan district attorney’s office stated they respect the court’s decision and will proceed with the remaining nine counts, which include the intentional second-degree murder charge. The sentence for second-degree murder in New York ranges from 25 years to life imprisonment.

The judge also rejected defense arguments for dismissing the case on grounds of double jeopardy, affirming that state and federal governments operate as “two sovereigns” with distinct laws. Furthermore, a defense request to put the state case on hold pending the federal trial was denied, with the judge citing no violation of Mangione’s right against self-incrimination.

Mangione is scheduled to return to state court on December 1. The case continues to draw considerable public attention, with supporters gathering outside the courtroom during his appearances, highlighting the contentious public debate surrounding the UnitedHealthcare executive’s killing. The US attorney general, Pam Bondi, previously called Thompson’s killing “a premeditated, cold-blooded assassination that shocked America,” underscoring the high stakes of the ongoing legal battle.
