Massachusetts has filed a lawsuit in state court against predictions platform Kalshi, accusing it of operating an unlicensed sports gambling service under the guise of event contracts. Attorney General Andrea Joy Campbell stated that Kalshi must obtain a proper license and adhere to state laws if it wishes to engage in sports gaming within Massachusetts.

The state is seeking a court order to prevent Kalshi from offering sports event contracts in Massachusetts while the lawsuit is ongoing. Kalshi, which is regulated by the Commodity Futures Trading Commission (CFTC) as a predictions market, has consistently argued in federal court that the CFTC’s federal authority supersedes state regulations.

Court documents filed with the Suffolk County Superior Court indicate that sports event wagers constituted a significant portion of Kalshi’s trading volume, comprising approximately 70% between February 25, 2025, and May 17, 2025. This figure reportedly rose to 75% from March 18, 2025, when Kalshi began offering single-game March Madness markets. The lawsuit claims that Kalshi generated more revenue from sports wagers than licensed sports betting platforms like DraftKings or FanDuel during the same period.
