A judge has lifted a gag order on pre-trial evidence, revealing that Patterson’s estranged husband, Simon Patterson, had suspected her of poisoning him more than a year before the fatal 2023 lunch.

The newly unsealed evidence includes Simon Patterson’s testimony, where he stated he declined the deadly lunch invitation out of fear. “I thought there’d be a risk that she’d poison me if I attended,” he told the court in a hearing prior to the trial. He detailed a history of unexplained illnesses, which he suspected were deliberate poisonings from various dishes prepared by his estranged wife between 2021 and 2022, prompting him to stop eating her cooking.

Further revelations include video footage of Erin Patterson’s police interview, recorded just a week after the ill-fated meal. In the interview, she was informed that her female victims were dead and their husbands critically ill. Patterson explained her motive for inviting her former in-laws, Don and Gail Patterson, and Gail’s sister Heather Wilkinson, stating she wanted to maintain her relationship with them as they were supportive and the only grandparents to her children.

Erin Patterson was convicted last month by the Victoria state Supreme Court for the murders of Don and Gail Patterson, and Heather Wilkinson, along with the attempted murder of Heather’s husband, Ian Wilkinson, who survived. Charges related to the alleged prior attempts to poison Simon Patterson were dropped before the trial began in April.

The release of this evidence comes as Patterson prepares to appeal her convictions. A sentencing hearing is scheduled to commence on August 25, where she faces potential life sentences for the murders. Victim impact statements are expected to be a significant part of the two-day hearing.
