In a move sparking outrage, the US Justice Department has recommended a one-day prison sentence for former Louisville police officer Brett Hankison, who was convicted of violating Breonna Taylor’s civil rights during the fatal 2020 raid on her apartment. This recommendation, which attorneys for the Taylor family have vehemently condemned as an “insult” and a message of “near-total impunity” for white officers, is set to be considered by a judge next week.

If the court accepts the Justice Department’s proposal, Hankison would serve just one day behind bars, with credit for time already served. He would also face three years of supervised release. Hankison was the sole officer charged and convicted in connection with the botched no-knock warrant raid that led to Taylor’s death, though prosecutors argued he did not fire the fatal shots. A federal jury had found him guilty of using excessive force, a charge that carries a maximum sentence of life in prison.

Prosecutors justified their recommendation by stating that the jury’s verdict effectively ends Hankison’s law enforcement career, and additional prison time would be “unjust under these circumstances.” However, this stance has been met with significant criticism, particularly from those who believe it undermines the pursuit of equal justice. The Breonna Taylor case, alongside George Floyd’s killing, became a focal point for the Black Lives Matter movement in 2020, highlighting issues of police accountability and racial justice.
