A federal judge in Washington, D.C., has blocked the Trump administration’s policy restricting migrants from seeking asylum after crossing the southern border. U.S. District Judge Randolph Moss issued a 128-page order on Wednesday, asserting that President Donald Trump cannot “adopt an alternative immigration system” and has exceeded his legal authority.

The ruling comes after Trump’s executive order in January, which declared the situation at the southern border an “invasion of America” and suspended the ability of migrants to seek asylum. Despite a recent Supreme Court ruling that limited judges’ power to block executive orders nationwide, Judge Moss concluded that this case warranted injunctive relief.

While acknowledging the executive branch’s significant challenges in deterring unlawful entry, Judge Moss emphasized that neither the Constitution nor the Immigration and Nationality Act grants the President unilateral authority to limit asylum rights for aliens present in the United States. The judge certified a class of all individuals covered by Trump’s executive order and stayed his decision for 14 days to allow for an appeal and implementation preparation.

Lee Gelernt, an attorney with the ACLU, hailed the decision, stating its “importance cannot be overstated” for those fleeing danger and reaffirming that the president cannot disregard laws passed by Congress.
