Kilmar Abrego Garcia, a Maryland resident previously wrongfully deported to El Salvador, is expected to be taken into ICE custody again today, Monday, August 25th. His attorney, Simon Sandoval-Moshenberg, voiced strong concerns about the impending detention, stating there is no immediate need given Garcia is already under electronic monitoring by the U.S. Marshals Service.

Garcia was released from criminal custody in Tennessee on Friday, August 22nd, after which he was instructed to report to an ICE detention center in Baltimore. Immigration officials subsequently informed his legal team of plans to deport him to Uganda, a move that followed Garcia’s rejection of a plea deal involving deportation to Costa Rica in exchange for a guilty plea on smuggling charges.

Sandoval-Moshenberg characterized the proposed Uganda deportation as a potential ‘means of punishment’ and expressed fear that it could ultimately lead to Garcia’s re-deportation to El Salvador. He emphasized that sending Garcia back to El Salvador, even indirectly through Uganda, would be as illegal as direct deportation, given his prior wrongful removal.

Despite the looming threat of detention, Garcia enjoyed a brief reunion with his family and 5-year-old child in Maryland over the weekend, arriving early Saturday morning. His attorney acknowledged this reprieve might be short-lived as ICE has stated its intent to deport him.
