Eight migrants have been deported to South Sudan by the Trump administration, with their plane landing just before midnight EST on Friday. This controversial move follows a pivotal Supreme Court decision on June 27, 2025, which clarified that the administration was not bound by a lower court order to hold the individuals at a U.S. military base in Djibouti.

The deportations mark a significant win for the administration, which a Department of Homeland Security (DHS) official confirmed proceeded after a lawsuit had previously halted their removal and diverted them to Djibouti. Assistant Secretary Tricia McLaughlin stated, “A district judge cannot dictate the national security and foreign policy of the United States of America. This Independence Day marks another victory for the safety and security of the American people.”

The eight individuals, whom DHS alleges have serious criminal convictions, were the subject of a legal battle that reached the highest court. The Supreme Court’s 7-2 decision effectively allowed the administration to proceed with the deportations to South Sudan, despite previous legal limbo. The ruling also noted that when it lifted judge-imposed due process requirements for third-country removals last month, the government could no longer be held accountable for allegedly violating those requirements.

However, lawyers representing the migrants have vehemently condemned the deportations. Trina Realmuto, one of the attorneys, called the action “punitive and unconstitutional.” She added, “Because of the Supreme Court’s procedural ruling, these men were denied an opportunity to contest their deportations to South Sudan based on their fear of torture or death. The U.S. State Department warns Americans against all travel to South Sudan yet deported these men there without any due process. Make no mistake about it, these deportations were punitive and unconstitutional.”
