Abrego Garcia to Remain Jailed as Deportation Uncertainty Continues

Kilmar Abrego Garcia, an individual facing human smuggling charges and alleged ties to the MS-13 gang, will remain in federal custody following a recent ruling by a Tennessee federal judge. The decision, made on Monday, comes after Abrego Garcia’s legal team requested his continued detention due to “contradictory statements” from federal authorities regarding his potential deportation.
The defense lawyers expressed concerns that Abrego Garcia could be deported before his trial concludes, despite previous assurances. Justice Department officials had indicated an intent to see the smuggling case through, though one attorney reportedly stated the U.S. government plans to deport Abrego Garcia to a “third country” rather than his native El Salvador, with no set timeline for removal.
U.S. Magistrate Judge Barbara Holmes had initially moved towards releasing Abrego Garcia during a June 25, 2025, hearing, setting conditions for his release to his U.S. citizen brother in Maryland. However, Holmes later reversed course, siding with the defense’s argument that the government might remove him from the country prematurely. His lawyers specifically asked the judge to delay his release until at least July 16.
Abrego Garcia’s case is complicated by a prior Supreme Court ruling that deemed his earlier return to El Salvador unlawful. He was arrested in Baltimore on March 12 on trafficking charges and alleged gang affiliations, having entered the U.S. illegally in 2011. Federal authorities claim he was involved in a human smuggling conspiracy, transporting individuals from Texas to Maryland.
