A newly appointed U.S. Attorney, Lindsey Halligan, is reportedly moving forward with plans to seek an indictment against former FBI Director James Comey, despite internal Justice Department prosecutors determining there was insufficient evidence to support charges of perjury and obstruction.

Sources with direct knowledge of the probe indicate that Halligan, a former personal attorney for Donald Trump with no prior criminal prosecution experience, intends to present evidence to a grand jury in the coming days. This move comes as the statute of limitations for the alleged offenses is set to expire next week.

Earlier this week, prosecutors presented Halligan with a detailed memo recommending against bringing charges against Comey, citing a failure to establish probable cause. This means investigators could not meet the legal standard required for an indictment, let alone a conviction beyond a reasonable doubt.

The controversial push follows direct public calls from Donald Trump for prosecutions against Comey and other political figures. On Saturday, Trump specifically urged Attorney General Pam Bondi to act, stating, “JUSTICE MUST BE SERVED, NOW!!!”

Halligan’s apparent plan has reportedly caused tumult within the United States Attorney’s Office for the Eastern District of Virginia. Her deputy has also expressed reservations about the politically charged case. This echoes a previous incident where Trump’s former nominee for the position, Erik Siebert, reportedly resigned after refusing to bring charges against New York Attorney General Letitia James.

The DOJ launched an investigation into Comey earlier this year following claims of sensitive document mishandling related to the 2016 Russia probe, an issue Trump has long used to criticize the former FBI director.
